Principle 6.04 of The Hong Kong Solicitors’ Guide to Professional Conduct, Volume 1 (3rd Edition) (“Guide”)

The Solicitors Disciplinary Tribunal (“Tribunal”) found the following complaints against the Respondent proved:

Complaint 1

The Respondent, a solicitor, had, in breach of Principle 6.04 of the Guide, failed to reply fully and promptly to the Law Society’s enquiry by its letter dated 5 November 2019 to explain his conduct in failing to deliver the accountant’s reports of the Firm for the accounting year from 1 April 2018 to 31 March 2019 to the Council of the Law Society on or before the due date as prescribed under Section 8 of the Legal Practitioners Ordinance and Rules 8(1) and 8(2) of the Accountant’s Report Rules.

Complaint 2

The Respondent, a solicitor, had, in breach of Principle 6.04 of the Guide, failed to comply with paragraph 2 of the resolution of the Investigation Committee as stated in the Law Society’s letter dated 10 August 2021 which required him to provide his full reply to the Law Society’s letter dated 5 November 2019 within 14 days from the date of receipt of the aforesaid resolution of the Investigation Committee.

 

The Tribunal ordered that:

  1. the Respondent be censured;
  2. the Respondent be fined HK$20,000 for each complaint (i.e. a total sum of HK$40,000); and
  3. the Respondent do pay the costs of the Law Society, the Prosecutor and the Tribunal Clerk, as summarily assessed by the Tribunal.
