Mutual Understanding between Immigration and Law Society

20 May 2005

In response to today's (May 20) media reports, the Immigration Department and the Law Society issued the following joint statement this evening:

The legal advice given by members of the Law Society in the recent television programme was a free service with the purpose of enhancing the general public's legal knowledge and awareness to abide by the law.

The Immigration Department respects the role and rights of solicitors in providing independent legal opinions to the public.

The Law Society agrees with the Government statement which reminds employers that foreign domestic helpers must only perform domestic duties for the contractual employer.

The opinion of individual Law Society member on any particular case should not be taken as legal advice for general use. Members of the public should approach a solicitor if they have any query regarding individual cases.

Both the Immigration Department and the Law Society share the view whilst they may have different opinions on interpreting individual legal provision, both parties are complementary in upholding the rule of law in Hong Kong.
